Terms & conditions
On the provision of psychological assistance services and sale of goods. The information provided below is an official offer (Public Offer) from Iryna Burkun Kanta (hereinafter "Provider"), to conclude an Agreement on the provision of services under established conditions with any individual (hereinafter "Client")
In accordance with Art. 633, 641 of the Civil Code of Ukraine, the terms of the Public Offer are the same for all consumers. Payment for services or goods according to the details specified in the Agreement is acceptance of this Public Offer and is equivalent to concluding an Agreement on the terms set out below
1
General provisions
1.1. Public Offer — Provider's proposal addressed to any individual to conclude an Agreement on the provision of psychological services and/or sale of goods on the terms set out
1.2. Acceptance — full and unconditional consent of the Client to conclude the Agreement on the proposed terms
1.3. Services and goods include:
  • Individual psychological therapy (online and offline);
  • Group therapy;
  • Corporate training;
  • Intervision and supervision for psychologists;
  • Non-medical ADHD assessment;
  • Metaphorical Associative Cards (MAC);
  • Other consulting and information services;
Characteristics of services and goods are defined on the Provider's website
1.4. Rates — cost of services and goods, which is set by the Provider and indicated on the Site or agreed individually

Subject of the agreement
2.1. Under this Agreement, the Provider undertakes to provide the Client with psychological services and/or access to purchased goods in accordance with the selected rate, and the Client undertakes to pay their cost
2.2. The list of services and goods, their characteristics and cost are indicated on the Provider's Site or agreed personally

Service delivery format
3.1. Psychological consultations are provided:
  • Online — through video communication platforms (Zoom, Google Meet, etc.);
  • Offline — in the psychologist's office at an address agreed with the Client;
3.2. The duration of one session is 50-60 minutes, unless otherwise agreed by the parties
3.3. The initial consultation (up to 20 minutes) is provided free of charge to determine the Client's request
3.4. Group therapy, intervision and supervision are conducted on agreed dates and times
3.5. Metaphorical Associative Cards (MAC) are delivered:
  • Individual psychological therapy (online and offline);
  • Electronically — in digital format (if provided);
3.6. A prerequisite for receiving online services is the Client's access to the Internet and appropriate equipment

Agreement conclusion procedure
4.1. The Agreement is considered concluded from the moment of:
  • Registration for consultation (through the website form, messenger or phone);
  • Selection of service/product and rate;
  • Full or partial payment (if partial payment is agreed with the Provider);
4.2. The fact of acceptance is successful payment for the selected service or product

Price and payment procedure
5.1. The price of services/goods is determined on the Site or agreed individually
5.2. Payment is made:
  • Cashless — by bank transfer to the Provider's account;
  • Through online payment services (LiqPay, Fondy, PayPal, Revolut, etc.);
  • Cash — at offline meeting (if agreed)
5.3. Payment can be made in hryvnias (UAH) or euros (EUR)

5.5. In case of partial payment without prior agreement, the Provider has the right to refuse to provide services with a refund
5.6. In case of non-use by the Client of paid services (missed session without notice), such services are not provided again and funds are not refunded
5.7. Refunds are possible only in cases provided for in Section 9 of this Agreement

Rights and obligations of the parties
6.1. The Provider is obliged to:
  • Familiarize the Client with this Agreement by posting it on the Site;
  • Provide services in accordance with the terms of the Agreement;
  • Maintain confidentiality of information received while working with the Client;
  • Inform the Client about changes in schedule or work format;
6.2. The Provider has the right to:
  • Change the terms of the Agreement, rates and work schedule, having previously notified the Client;
  • Involve third parties to fulfill their obligations;
  • Refuse to provide services in case of violation by the Client of the terms of the Agreement or unethical behavior;
  • Postpone or cancel a session in case of force majeure or illness;
6.3. The Client is obliged to:
  • Comply with generally accepted standards of behavior;
  • Pay for services and goods in a timely manner;
  • Notify the Provider about cancellation or postponement of a session at least 24 hours in advance;
  • Not copy or distribute materials received during work (MAC decks, methodological materials, etc.) without the written consent of the Provider;
  • Use purchased goods only for personal use;
6.4. The Client has the right to:
  • Choose the work format (online or offline);
  • Receive the paid service or product in full;
  • Contact with questions and wishes regarding the work process;

Liability of the parties
7.1. For failure to fulfill obligations, the Parties are liable in accordance with the Agreement and the legislation of Ukraine
7.2. The Provider is not liable for:
  • Results of psychological work, as they depend on the Client's personal efforts;
  • Technical problems during online sessions on the Client's side (lack of internet, equipment malfunction);
  • Application of knowledge or materials received during work;
7.3. In case of violation by the Client of the Provider's intellectual property rights (copying, distribution of MAC materials or other copyrighted products),
the Provider has the right to:
  • Terminate the provision of services without refund;
  • Demand compensation for damages;
7.4. The Client bears full responsibility for the accuracy of the provided personal data
8
Force majeure
8.1. The Parties are released from liability for non-fulfillment of obligations due to force majeure
8.2. Force majeure circumstances include:
  • Military actions, terrorist acts, civil unrest;
  • Quarantine restrictions;
  • Natural disasters;
  • Disruptions in electricity and Internet nationwide
8.3. In case of force majeure circumstances, the Provider undertakes to notify the Client and agree on the possibility of postponing the session or refunding

Refunds and cancellation
9.1. Refunds are possible in the following cases:
  • The Provider cannot provide the service for reasons beyond the Client's control;
  • Cancellation of the session by the Client at least 48 hours before the start (by agreement);
  • Force majeure circumstances;
9.2. Funds are not refunded in cases of:
  • Missing a session by the Client without notice;
  • Cancellation of the session less than 24 hours before the start;
  • Non-use of paid services for reasons beyond the Provider's control;
  • Violation by the Client of the terms of the Agreement;
9.3. Refunds for goods (MAC) are possible only in case of defect or inadequate quality, subject to preservation of packaging
10
Term of the agreement
10.1. The Agreement enters into force from the moment of payment and is valid until the Parties fully fulfill their obligations
10.2. The Provider has the right to terminate the Agreement unilaterally in case of violation by the Client of its terms
11
Confidentiality
11.1. The Provider guarantees the confidentiality of all information received while working with the Client
11.2. Exceptions are cases provided for by the legislation of Ukraine (threat to the life of the Client or third parties)
11.3. The Client provides consent to the processing of their personal data in accordance with the Law of Ukraine "On Protection of Personal Data"
12
Other provisions
12.1. All exclusive property rights to copyrighted materials (MAC, methodologies, texts) belong to the Provider
12.2. The Client does not have the right to transfer their rights and obligations under this Agreement to third parties without the written consent of the Provider
12.3. The Parties have agreed on the possibility of using electronic correspondence (email, messengers) as a proper form of communication
12.4. All disputes are resolved through negotiations. In case of impossibility to reach an agreement — in accordance with the legislation of Ukraine
